
根據(jù)《中華人民共和國(guó)合同法》規(guī)定,遵循平等自愿、互利公平和誠(chéng)實(shí)合作的原則,明確雙方權(quán)利義務(wù)關(guān)系,經(jīng)甲乙雙方協(xié)商達(dá)成如下協(xié)議:一、 甲方委托乙方負(fù)責(zé)甲方新,舊辦公院內(nèi)外所有花草樹(shù)木的養(yǎng)護(hù)和管理。二、 期限:養(yǎng)護(hù)期為一年,自 年 月 日起至 年 月 日止。三、 養(yǎng)護(hù)費(fèi)用為人民幣 元,大寫: 。四、 付款方法:合同到期后經(jīng)驗(yàn)收一次性付清。 五、 甲方負(fù)責(zé)養(yǎng)護(hù)范圍內(nèi)所有苗木的安全管理,如人為損壞由甲方全部負(fù)責(zé)。甲方提供水源、電源、工具臨時(shí)安放點(diǎn)(水、電費(fèi)由甲方負(fù)擔(dān))。如因水、電源不暢而造成養(yǎng)護(hù)范圍內(nèi)的植物死亡,造成的損失由甲方負(fù)責(zé)。六、 乙方在接管養(yǎng)護(hù)前應(yīng)清點(diǎn)甲方現(xiàn)有的苗木,如有死亡和無(wú)法補(bǔ)救的苗木,要向甲方提出并記錄在案,乙方在養(yǎng)護(hù)期間如有花木自然死亡,乙方要及時(shí)報(bào)知甲方,協(xié)商補(bǔ)種。七、 乙方在養(yǎng)護(hù)期間,嚴(yán)格按《太原市綠化養(yǎng)護(hù)條例》標(biāo)準(zhǔn)養(yǎng)護(hù)管理。如乙方未按條例養(yǎng)護(hù),造成損失,甲方有權(quán)要求乙方承擔(dān)相應(yīng)的賠償責(zé)任。
